Health insurance dependants: residence requirement for foreign nationals
Two different legal mechanisms get merged into one sentence about visas. The Act itself excludes a workplace subscriber's spouse and children under 19 from the waiting period; separately, certain statuses and circumstances are treated as making long-term residence evident, which drives a different acquisition-timing rule rather than an exemption from this one. Guidance listing student, permanent residence, marriage migrant and non-professional employment statuses as simply exempt is describing the second mechanism in the language of the first, and the distinction changes what evidence is needed.

What we have recorded
- 2026-09-216 months
In force from 3 April 2024, with transitional provisions applying it to those entering from that date. Applies in addition to the relationship, support, income and property conditions. Statutorily excluded: a workplace subscriber's spouse, their children under 19, and the spouse's children under 19. Distinct from that, statuses and circumstances indicating that residence of six months or more is evident carry their own acquisition-timing rules. Residence is assessed on immigration records rather than counted as 180 calendar days, and departures affect it.
